An issue arose recently regarding the replacement of siding on homes within the subdivision. In particular, the Board was asked to consider whether the use of vinyl or aluminum replacement siding material is permitted.
The Board met on February 29, 2000 and unanimously agreed that such materials are not permitted for use as siding on any home within the subdivision. The Board passed a resolution that samples of materials proposed for use must be submitted for approval by the Board before installation on a house, however, in no event will aluminum or vinyl siding be approved.
The authority for the Board to act in this area is expressly contained in the deed restrictions, which uniformly apply to all homes in the subdivision. Section 18 entitled “architectural control” states:
“No building or other structure shall be constructed, erected, or maintained, nor shall any addition to, or any change or alteration to any structure be made, except interior alternations, until plans and specifications, prepared by a competent architect showing the nature, kind, shape, elevation, façade, height, and materials, color scheme, location on lot and approximate cost of such structure has been submitted to and approved in writing by the Grantor…”
No houses in the subdivision were constructed using aluminum or vinyl siding. The goal here is to ensure that the original common design features of the development are maintained, without unduly limiting the remodeling and maintenance choices of individual homeowners.
